A. Registration of Energy Service Companies (ESCO) from other Member States.
Energy Service Companies licensed and/or certified in other Member States may establish themselves in the Republic of Cyprus and provide energy services, provided that they are registered in the National Register of Energy Service Providers. This registration is made by an application to the competent authority, using the application form in Annex I of the Energy End-Use Efficiency and Energy Services (Energy Service Companies) Regulations of 2014 (KDP 210/2014).
The application examination fee for registering in the National Energy Service Companies Register is 200 EUR.
Β. Temporary and Occasional exercise of services by Energy service companies from other Member States:
An Energy Service Company established in another Member State may provide energy services in the Republic of Cyprus without the obligation to register and without the obligation to issue a licence, provided that it moves to the Republic in order to perform its services temporarily and occasionally and as long as in the Member State the Energy Service Company is established, exercises legally its profession and has the right to provide services similar to those intends to carry out in the Republic of Cyprus.
An Energy Service Company that intends to provide services in the Republic of Cyprus according to the aforesaid paragraph, before the start of such services, must notify the Competent Authority (Energy Service of the Ministry of Energy, Commerce and Industry) in writing. The Energy Service Company which enters into an Energy Efficiency Contract (EPC) in Cyprus must inform the Competent Authority within 10 days from the date of signing the EPC.
The Competent Authority assesses on a case-by-case basis the temporary and occasional nature of the provision of an Energy Service particularly in relation to its duration, frequency, periodicity and continuity.
An Energy Service Company established in a Member State temporarily providing its services according to the above, shall be subject to the professional or administrative provisions of the Cypriot law, but shall not be required to register or participate as a member in local or other associations.
